CeMar Surgery Agreement incorporates these Terms of Service: our Privacy Policy, our Disclaimer, our Deposit, Refund, and Cancellation Policy, and all incorporated policies. CeMar operates under the name CeMar Surgery, which owns www.cemarsurgery.com.

To use the services offered on cemarsurgery.com or by any of its affiliates, you must agree to the following conditions. If you visit, provide information, or become a client of CeMar Surgery, you agree to these conditions. Please read them carefully.

CeMarsurgery.com may modify these conditions at any time, and those modifications will be effective immediately after posting the modified terms and conditions. Accessing or using our services constitutes your acceptance of these conditions as they appear at the time of your access or use.

TERMS OF SERVICE

1. MEDICAL EMERGENCIES

IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD NOT RELY ON THIS WEBSITE FOR SPECIFIC ADVICE OR TO FIND EMERGENCY SERVICES, BUT INSTEAD, YOU SHOULD SEEK APPROPRIATE EMERGENCY MEDICAL ASSISTANCE. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, PLEASE CALL 911.

1.1. Aware of possible risks and complications. CeMar (DBA: CeMar Surgery) is a scheduling facilitator and not a healthcare provider. I am NOT relying on any statements made or implied by staff / employees of CeMar Inc. (DBA: CeMar Surgery), as I understand that they are not medical doctors. The surgeon performing my procedure is the only qualified person to medically treat me or give me medical advice. My decision to have this procedure performed is based on my own research and may be based in part on the advice received from my personal, licensed medical physician.

In addition, customers are required to know:

  • Customers are required to be satisfied with the more common risks and complications of this surgical procedure and associated treatment(s) and costs, including but not limited to: bleeding, infection, anesthesia risks, and death.
  • Customers are required to be satisfied with the understanding of all risks and complications of this surgical procedure and associated treatment(s) and costs including but not limited to: (doctor(s) to describe specific risks and complications when applicable).
  • Customers are required to be satisfied with the understanding of alternative surgical procedures and associated treatment(s) and costs and their possible benefits, risks and complications including: (doctor(s) to describe alternative procedures and their risks and complications when applicable).
  • Customers are required to be satisfied with the understanding of the possible consequences, outcomes or risks if no treatment is rendered.
  • Customers are required to understand that there are risks involved in any surgical procedure and associated treatment(s), and it is not possible to guarantee or give assurance of a successful result.
  • Customers are required to be aware that they are fully responsible if they take it upon themselves to leave earlier than CeMar Surgery package requires; CeMar Surgery, the hospital facility, nor the physician(s) are in any way responsible.
2. PRIVACY

Review our Privacy Policy, which also governs your visit to www.cemarsurgery.com, to fully understand our practices.

3. ELECTRONIC COMMUNICATIONS

When you visit www.cemarsurgery.com or send us emails, you are communicating with us electronically. By communicating with us, you agree to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

If you make an error in your payment or scheduling of your surgery, we reserve the right to contact you via phone, email, and/or text message. Any prior settings to disable these methods of communication may be overridden.

The security of any data you send through this site is crucial to us, but no system can perfectly protect against the risks of intentional intrusion or inadvertent disclosure of the information you send to us. Additionally, when you transmit information over the internet, the security of the transmission may be compromised before it reaches us. Consequently, CeMar does not guarantee confidentiality or security. YOU EXPRESSLY AND SOLELY ASSUME THE RISK OF ANY UNAUTHORIZED DISCLOSURE OR INTENTIONAL INTRUSION OR OF ANY DELAY, FAILURE, INTERRUPTION, OR CORRUPTION OF DATA OR OTHER INFORMATION TRANSMITTED IN CONNECTION WITH YOUR USE OF www.cemarsurgery.com.

5. TRADEMARKS

A. Protected Trademarks and Graphics. All trademarks of CeMar Surgery, graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dress of CeMar Surgery or its affiliates. CeMar Surgery's trademarks and trade dress may not be used in connection with any product or service that is not CeMar Surgery's in any manner that may cause confusion among customers or in any manner that disparages or discredits CeMar Surgery. These trademarks include, among others, "CeMar Surgery" www.cemarsurgery.com, and its design. All other trademarks not owned by CeMar Surgery or its affiliates and appearing on this site are the property of their respective owners, who may or may not be affiliated, connected, or sponsored by CeMar or its affiliates.

6. LICENSE AND SITE ACCESS

CeMar Surgery grants you a limited license to access and use this site for personal use and not to download it (except for page caching) or modify it, or any portion of it, except with the express written consent of CeMar Surgery.

7. OPINIONS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

A. Nature of Content. Visitors to www.cemarsurgery.com may post reviews, comments, and other content, and submit suggestions, ideas, comments, questions, or other information, provided that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing on intellectual property rights, harmful to third

B. Offer of Medical Tourism Insurance. I understand that CeMar (DBA: CeMar Surgery) offers Individual Medical Tourism Insurance coverage (https://cemarsurgery.com/medical-tourism-insurance/) for an additional fee, through xxxxxxxxxx. By not purchasing this insurance plan, I assume all risks associated with travel and medical procedures. Furthermore, I understand that the Individual Medical Tourism Insurance coverage offered by CeMar may only cover a portion of the liability incurred during the trip or medical procedure(s).

D. Understanding the Services Provided by CeMar. I am satisfied with my understanding of the nature of my surgery and associated treatments; all questions regarding these treatments and procedures have been answered.

E. Recommending Flight Travel Insurance. CeMar (DBA: CeMar Surgery) strongly recommends purchasing Flight Travel Insurance to cover trip cancellation and interruption. You can obtain this insurance when purchasing your plane tickets.

F. Understanding our Deposit, Refund, and Cancellation Policy. CeMar (DBA: CeMar Surgery ) requires a deposit to become a client, which has terms outlined in our Deposit, Refund, and Cancellation Policy. CeMar (DBA: CeMar Surgery) also governs deposits, cancellations, and postponements according to this policy.

9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THIS SITE IS PROVIDED BY CeMar "AS IS" AND "AS AVAILABLE." www.cemarsurgery.com MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON THIS SITE.
